What should I do when I receive my scooter?

When you receive your new scooter there are a couple of things to do while you are completing any assembly required. Although the scooters come mostly assembled from the factory it is still a good idea when you receive your scooter that you go over all bolts, nuts, screws and hardware, for example the muffler mounts, axel bolts, engine Bolts etc. to assure everything is tight and secure. As an extra step of added insurance you may want to obtain some blue Lock Tight at your local auto parts and use it on any bolts that may come loose from vibration. For gas scooters you will also need 2-stroke oil and mix as directed in your user manual. For electric scooters please be sure to charge your scooter after each use to insure a long battery life.

What do you do with my credit card number?

No credit card numbers are stored on our computer or saved for any reason. The numbers are taken and processed immediately by secure eCommerce servers run by Yahoo.com. Your order is then encrypted before being sent to EarthScooters.com. Your card information couldn't be safer.

Shipping Information
At EarthScooters, we want to see your package arrive safely.  We use Fed-Ex, UPS or DHL Ground services to ship all of our packages unless a common carrier is needed for larger items.  Once your order is shipped from our docks at EarthScooters, you will then be automatically contacted via email with your tracking and shipping information.  You can then log-on directly through your order tracking email to track your package  and know when it is going to arrive to your home.  Once you receive your information, you may want to print it out for later use in tracking your order.

Expected Delivery
Most generally, you should receive your package within 7-10 business days once it leaves our docks.  Orders will "normally" ship out within 2-3 business days after your order is received here at EarthScooters.  With larger orders or heavy items such as Mini Choppers, Pocket Bike Scooters, 3-wheel scooters and during the holiday season this time could vary.  EarthScooters is not liable for any delays after the order has shipped.  If an item is Out Of Stock at the time of your order, we will place you on our wait list for the product and you will receive an email concerning your back ordered product.

Disclaimer - Terms of Sale

The products on this site are designed for recreational and/or for personal transportation of a single rider with proper safety equipment. It is not suitable for handicapped persons or persons with limited mentality or physical capacities. The product is to be used only on safe, dry, smoothly paved or hard packed surfaces, in accordance with local regulations, during daylight hours. Please remember to always wear a helmet!

There are inherent dangers to using motorized scooters. Purchaser shall use products at their own risk, EarthScooters will not be held liable under any circumstance  for for incidental or consequential loss or damage or injury due to the direct or indirect use, misuse or abuse of any product purchased from EarthScooters, including any malfunction.

Although there are no uniform legal age restrictions for the use of motorized scooters, we recommend that only individuals of legal age use any of the scooters sold by EarthScooters. Children may use products under adult supervision and under the guardian’s own discretion. Check with your local authorities for area specific rules and regulations. Adult guardian assumes all responsibilities associated with the use of these products by minors. Customers understand that the use of these products can cause injury or death. To prevent it, we strongly recommend the use of the safety equipment such as helmet and knee pads. The user holds Seller and his agents harmless from any liability. Purchaser obtains her/his own insurance. Seller assumes no suitability of any of these products as to size, age and other factors largely depend on personal discretion.

Products are not regulated by the U.S. Department of Transportation as motor vehicles (except the gas series in some states). Therefore, they do not necessarily comply with the Federal Motor Vehicle Safety Standards. It is the customers’ responsibility to check with their local authority since the law varies state by state.

Release

The User releases EarthScooters, its officers, agents, sponsors and employees from claims, demands and damages (both actual and consequential), of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with items purchased, or purchases made on or through this website.

Limitation of liability

In no event shall EarthScooters or its suppliers be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site or items purchased on or through our site or this agreement (however arising, including negligence). Our liability, and the liability of our suppliers, to you or any third parties in any circumstance is limited to the User's cost of qualifying products purchased at the time of entering into the agreement. Qualifying products as acceptable for return as outlined in the return policy.

Product information is provided on an "as is" basis, without warranty of any kind, either expressed or implied, including, without limitation the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Indemnification

User hereby agrees to defend, indemnify and hold harmless EarthScooters, its officers, directors, employees and agents, for any loss or damages awarded by a court of competent jurisdiction resulting from any claim, action, or demand, including reasonable attorneys' fees, arising out of or related to products purchased on this website, or the violation of the agreement by the User.

Purchasers Responsibility

You must inspect all equipment before using it and to take full responsibility for assuring that the equipment is in good working order and safe to use. You further understand that you are responsible for damage to equipment. Purchaser understands the nature of motor scooter riding and motorcycle related activities and acknowledges that Purchaser is qualified to operate said motor scooter, and is in proper physical condition to participate in such activity. Purchaser agrees to assume all risks when allowing others to operate Purchaser s scooter. If Purchaser is not familiar with the nature of motor scooter riding, Purchaser should seek professional training before operating a scooter.

Inherent Risks

Warning! Scooter riding activities involve the risk and danger of serious bodily injury including, but not limited to, disability, paralysis, dismemberment and death. These inherent risks and dangers may be caused by Purchasers own actions or inactions, the actions or inactions of others, participating or not participating in the activity, the condition in which the activity takes place, or the negligence of others. There may be additional risks, including social and economic loss, either known or unknown to Purchaser, not readily foreseeable, and Purchaser fully accepts and assumes responsibility for all such risks, losses, costs, and damages incurred as a result of Purchasers participation in scooter riding activity.

Operation, Registration, and License

Purchaser is responsible for registering and operating the motor scooter in accordance with local and state laws and ordinances. Seller makes no representations that the motor scooter is legal for operation in your City and State.

Order Cancellations
Once an order has been made and processed, it cannot be cancelled
as well as shipping cannot be stopped once in route.  If you so choose to cancel an order once processing has been made, you will be charged for full return shipping (if shipping has occurred) and a 30% restocking fee based on the full purchase price before actual shipping charges incurred in shipping your order.

Shipping Damages
All  scooters, pocket bikes, mini choppers etc. are completely checked and free of damage or breakage before shipping.   Proper sealing and straps on the shipping box or container are also checked before leaving EarthScooters.  Any damages there after have occurred during the shipping process.  It is very important that you inspect your scooter and have the driver note if there is any damage at the time of delivery.  Any damage claims made after delivery and not noted by the driver will not be honored by the carrier.  By signing the bill of lading you are releasing EarthScooters.com and the shipping carrier from any liability of shipping damage.  If the customer refuses shipment because of major damage a replacement will be sent free of charge within 3 business days if the item is in stock.  If order is canceled because of damage 30% cancellation fee and all applicable shipping fees will apply.  You must file report and claim to shipping agent within three (3) days of receipt.  We must be notified within 7 days of delivery for any shipping damages.    Earthscooters is not responsible for damages originating from shipping.   Any damage claims submitted to EarthScooters.com without following these procedures will not be honored.

Shipping Damages and Warranty Parts Replacement Procedure

For Shipping damage the customer must file a damage claim with the shipping carrier.  To obtain replacement parts contact us at support@earthscooters.com with your name, order number, address the parts are to be sent to, phone number you can be contacted at, a brief summery explaining what the damage is, the damage claim number from the shipping carrier and pictures of the items damaged so we can send out the correct replacement parts. Please make sure you follow this carefully so we can get your manufacturer's product warranty parts or replacement parts shipped with out any delay.  We must be notified within 7 days of delivery for any shipping damages.  Any damage claims submitted to EarthScooters.com after 7 days will not be honored.

Our Returns Policy
NOTE:  All returns must have a Return Authorization Number
Earth Scooters will accept authorized returns on "unused" bikes and scooters only for a period of  7 days from date of delivery.  This does not include larger pocket bikes, 3-wheel scooters or mini chopper type scooters which are not returnable.
The term "Unused" means that the bike or scooter has not been assembled, fueled or ridden in any way, shape or form.  All returns and refused shipments are subject to a 30% restocking / handling fee less shipping charges.   All shipping fees incurred by EarthScooters are nonrefundable under any circumstances.   All Returned bikes or scooters will take up to 1 full week (7 days) to process your refund from the time the scooter has been returned and inspected this amount is based from the amount of purchase before shipping cost (to & from).  There is no refund on shipping costs incurred in sending or returning your order.  Scooters have many plastic parts including a plastic hard shell body which can easily become damaged during shipping. Please Note These scooters may not be returned or refused for cosmetic damage such as scratches or minor adjustments.  The selections of colors are current, however our stock changes quickly and an alternate color or will be shipped if your color or is unavailable at time of shipping without prior customer notification.  Returns or refusals of delivery for wrong color being received are treated as a return and are subject to all return and shipping fees described this policy.

Terms Of Our Return Policy
1.
  Product must be in original container or box and must be in new and resalable condition.  Product must have all owners manuals, accessories and keys.  If any items including original parts, original packaging materials, manuals, tags, labels, keys, accessories, stickers or other documentation are missing, you will be charged a 50% restocking fee based on the full purchase price less shipping charges.
2.  You will be responsible for return shipping charges and shipping must be paid from the purchasers end.  Return shipping must be made via the carrier that delivered the package only.  You will be responsible for the return shipping fully and any damage that may occur during the return shipping therefore we suggest that you purchase shipping insurance on the return of the product.  Any damages in returning the product without insurance will result in a 50% restocking fee.
3.  Your returned product must have the return authorization number clearly marked on the package when we receive it back in our shipping department.  Any products or packages returned to our shipping department without the return authorization number on it will be charged a 50% restocking fee.

Refused Deliveries
If a customer refuses delivery of a purchase they have made, they will be responsible for "All To And From Shipping And Handling Charges" incurred in shipping your order and a 30% percent restocking fee.  There will be no refunds until the product is received back at our facilities.  Shipments can not be refused for the wrong color being received. 
If the customer refuses shipment because of major damage a replacement will be sent within 3 business days free of charge.  Scratches or broken accessories are not considered major damage.  If scooter refused for damage is deemed to not be major damage a 30% restocking fee and shipping fees will be billed.  If order is canceled because of damage 30% cancellation fee and all applicable shipping fees will apply.  You must allow us to send a replacement scooter to you.

Scooter Warranty
All scooters & bikes come with a 30 day
limited  manufacturer's defects parts warranty accept for Bladez and GoPed which has a 90 day limited parts warranty. This does not include wear and tear on parts such as brakes, tires, seats, brake handles, lights, light bulbs, or any plastic body parts, housings or casings nor does it include adjustments to the motor, brakes, chain, loose nits, bolts, engine damage or any other part of the scooter or bike due to mishandling, misuse or abuse.  Warranty will be void if the scooter is used for other means than designed for.  This also includes being driven off road, used in competition racing, or rented as a commercial vehicle.  Any defective parts being sent back will need a return authorization number from Earth Scooters before being sent back.  Once the part is received, it will be evaluated by a scooter technician for it's defect.  You will be responsible for shipping the broken part to us or when possible providing adequate pictures of the problems in lieu of returning the parts.  Once we receive the broken part, we will ship you the replacement part.  No part/parts that contain fuel can be shipped under federal regulations.
A 60 Day Extended Parts Warranty is "available for purchase" for $99.00 on all scooters and must be obtained at the time of purchase.  This extended warranty cannot be purchased once the product has been shipped.  This warranty does not include mishandling, misuse or abuse and a core exchange must be shipped before replacement will take place.  This warranty does not cover labor expenses.  Customer will be responsible for shipping of core to our facilities for exchange and pay shipping charges.  Earth Scooters reserves all rights to determine weather part/parts have been misused or mishandled.  You must contact us before shipping of warranted parts and shipment must have a warranty authorization number when received.  Please contact us for your authorization number before shipping at support@earthscooters.com

Please Note:

1. There are no agreements or warranties, expressed or implied including warranties of merchantability or fitness for a particular purpose,  other than those stated in this agreement.
2. This warranty is effective only if the product is used under normal conditions for its intended purpose and the product receives all necessary maintenance and adjustments.
3. This warranty dose not cover any adjustments that may need to be made to the scooter for example adjustments to the chain, carburetor or brakes.
4. This warranty dose not cover the cost of instillation for repairs and is for a replacement of defective parts only.
5. This warranty extends only to the original customer and is non-transferable.
6. Parts and models are subject to change without notice.
7. Terms on all sales: All sales are considered final. Should you have a problem with any component or part, we will replace it at no charge to you if it is covered under our warranty.
8. It is your responsibility to replace the part at your own expense.  The Customer Must Contact The Manufacturer or Importer For Warranty Disputes. Most parts are easy to switch out. We do not replace normal wear parts as outlined in our warranty above. We reserve the right to change model specifications without notice.  We are not responsible for typographical errors or changes in product specifications.
9. We never accept returns of used scooters.

These scooters may not be returned for cosmetic damage such as scratches or minor adjustments.

If you wish to obtain repair services without a warranty or after your warranty has expired, you may do so through our service and parts department.  There will be a $30 per hour labor charge plus the cost of all parts.  You must also provide shipping to and from our service center including shippers insurance and a $40 money order for the return shipping of your repair.  Please make arrangements with us before shipping so that parts can be made available for the repair.  You must contact us for a repair authorization number before shipping at support@earthscooters.com
